These service terms are designed to clarify the rights, obligations, and responsibilities of both parties during the use of the Company’s services. They apply to all services provided by the Company, including but not limited to various photography shooting services (such as portrait photography, landscape photography, commercial photography, etc.), photography post-production services, photography course training services, and related online platform services.
2. Acceptance of the Terms
When you use any of the Company’s services, it means that you have carefully read, understood, and agreed to accept all the contents of these service terms. If you do not agree with these service terms, please do not use the Company’s services. If you are a minor, you should read these service terms accompanied by your legal guardian and use the Company’s services only with the guardian’s consent.
II. Service Content and Provision
1. Service Introduction
- Photography Shooting Service: The Company provides you with a professional photography team. According to your needs, the team will take photos of various subjects at the agreed time and location. Before the shooting, we will communicate with you in detail about the shooting style, scene, clothing, props, and other details to ensure that the shooting effect meets your expectations.
- Photography Post-production Service: For the completed photos, the Company provides professional post-processing services, including but not limited to image color adjustment, flaw repair, photo layout design, etc., to create high-quality photographic works for you.
- Photography Course Training Service: The Company has a professional photography instructor team that offers diverse photography courses for users with different photography levels. The courses cover photography basic knowledge, shooting techniques, the use of post-processing software, etc. The course forms include online live courses, offline physical courses, and video tutorials.
- Online Platform Service: The online platform operated by the Company provides you with 5functions such as service reservation, work display, and user communication community. You can view the Company’s service items, prices, user reviews, and other information on the platform and reserve services conveniently and quickly. At the same time, you can also display your own photographic works on the platform and exchange and share experiences with other photography enthusiasts.
2. Service Provision
- The Company will perform its service obligations in accordance with the agreed service content, time, location, etc. If the service cannot be provided on time or in quality due to the Company’s reasons, the Company will promptly notify you and take remedial measures according to the specific situation, such as rescheduling the service time, adjusting the service content, or providing corresponding compensation.
- You should provide the necessary information and assistance as required by the Company before the service, such as the shooting theme, personal preferences, and the basic level of participation in training, so that the Company can better provide services for you. If the service is delayed or cannot be carried out normally due to your incomplete or inaccurate information provision or failure to fulfill the assistance obligation, the Company will not be liable.
III. Service Usage Specifications
1. Account Registration and Management
- Registration Requirements: If you want to use some of the Company’s services that require account registration, you need to provide true, accurate, and complete personal information, including but not limited to your name, contact information, etc. You shall be responsible for the authenticity and legality of the information provided. If you provide false information, the Company has the right to suspend or terminate your account usage and refuse to provide services.
- Account Security: You are responsible for properly keeping your account and password and shall not transfer, lease, or sell the account to others. If you find any abnormal login or other security issues with your account, you should immediately notify the Company. Any losses caused by your failure to properly keep your account and password shall be borne by you.
- Account Usage Restrictions: During the use of your account, you should abide by these service terms and relevant laws and regulations and shall not use the account to engage in any illegal or 违规 activities, such as publishing illegal information, infringing on others’ intellectual property rights, conducting online fraud, etc. If you violate the account usage regulations, the Company has the right to take measures such as restricting account functions, freezing the account, canceling the account, etc., and shall investigate your legal liability in accordance with the law.
2. Service Reservation and Payment
- Reservation Process: You can reserve services through the Company’s online platform or other designated channels. During the reservation process, you need to carefully read the service details, price, service time, etc., and fill in the relevant order information according to the system prompts. After submitting the order, you will receive an order confirmation message, and the order will take effect from the time of confirmation.
- Payment Method and Time: The Company provides a variety of payment methods for you to choose from, and the specific payment methods shall be subject to the display on the reservation page. You should complete the payment within the time specified in the order. If the payment is overdue, the order will be automatically cancelled. If the service cannot be reserved normally due to payment problems, the Company will not be liable.
- Price Adjustment: The Company has the right to adjust the service price according to market conditions, cost changes, and other factors. The price adjustment will be announced on the Company’s website or relevant service platform. For services that have been reserved and paid for, the price adjustment will not affect your order; for orders that have not been paid for, the adjusted price will be applied.
3. Service Change and Cancellation
- Change or Cancellation Initiated by the User: If you need to change or cancel the reserved service, you should notify the Company at least [X] working days before the service starts. The specific regulations for changes and cancellations may vary depending on the type of service. Please check the reservation page or consult the Company’s customer service for details. If you apply for a change or cancellation of the service within the specified time, the Company will handle it according to the actual situation and may charge a certain handling fee; if you apply for a change or cancellation of the service after the specified time, the Company has the right to refuse the application and will not refund the paid fees.
- Change or Cancellation Initiated by the Company: If the Company needs to change or cancel the reserved service due to force majeure, government actions, technical failures, or other unforeseeable and unavoidable reasons, it will promptly notify you. For service changes, the Company will negotiate a solution with you; for service cancellations, the Company will refund the paid fees in full but will not be liable for other additional losses.
IV. User Code of Conduct
1. Compliance with Laws and Regulations
During the use of the Company’s services, you should strictly abide by the laws and regulations of the People’s Republic of China and other relevant countries and regions and shall not use the Company’s services to engage in any illegal or criminal activities, including but not limited to creating, disseminating, or publishing information containing obscenity, pornography, violence, terror, gambling, drugs, inciting remarks, infringing on others’ privacy, and other illegal contents.
2. Respect for Intellectual Property Rights
- All intellectual property rights related to the Company’s services, including but not limited to photographic works, course materials, software programs, website content, etc., are owned by the Company or relevant right holders. Without the written permission of the Company or relevant right holders, you shall not copy, disseminate, modify, sell, lease, license others to use, or otherwise infringe on the intellectual property rights of the Company and relevant right holders.
- The works you generate during the use of the Company’s services (such as the photographic works you upload to the platform, etc.) are owned by you in terms of intellectual property rights, but you grant the Company a worldwide, permanent, free, and non-exclusive license to use, copy, modify, disseminate, display, and promote your works for the purposes of the operation, publicity, and promotion of the Company’s services.
3. Maintenance of Service Order
You shall not interfere with, damage, or attack the Company’s service system, including but not limited to using hacking technology, malicious software, web crawlers, and other means to affect the normal operation of the service. At the same time, you shall not publish spam emails, advertising information, false information, and other contents that affect the user experience of other users on the Company’s service platform.
4. Respect for the Rights and Interests of Others
During the use of the Company’s services, you should respect the legitimate rights and interests of other users and the Company’s staff and shall not engage in improper behaviors such as abuse, harassment, slander, threat, etc. If the rights and interests of others are damaged due to your behavior, you shall bear the corresponding legal liability.
V. Service Quality and Guarantee
1. Service Quality Standards
The Company will provide high-quality services for you with a professional and responsible attitude, in accordance with the industry’s general standards and the requirements agreed with you. In the photography shooting service, ensure that the shooting equipment is in normal operation and the shooting team is professional and dedicated; in the post-production service, ensure that the post-processing effect meets the industry standards and your expectations; in the training service, ensure that the instructors are qualified and the teaching content is accurate and practical.
2. Service Quality Feedback and Complaint
- If you are not satisfied with the service quality of the Company, you can feedback to the Company through the complaint channels on the Company’s online platform, customer service hotline, etc. When providing feedback, please specify the service order information, the specific content of your dissatisfaction, and the expected solution in detail.
- The Company will contact you within [X] working days after receiving your feedback to understand the specific situation and give a handling plan within [X] working days. For reasonable complaints, the Company will actively take measures for improvement, such as providing the service again, giving compensation, etc.
3. Service Improvement and Optimization
The Company will continuously improve and optimize the service content, process, and quality according to user feedback, market demand, and industry development trends. Your suggestions and opinions are very important to us, and you are welcome to put forward valuable suggestions to the Company at any time.
VI. Privacy Protection
